  1. CONTEST PERIOD: There are two (2) ways to potentially win in the Diana® Sauce and Marinade “Canada’s Greatest Griller” Promotion (the “Contest”):
    1. By submitting a video clip and a recipe OR a photo of your creation and the corresponding recipe (a “Sweepstakes Entry”) to enter for a chance to win a Sweepstakes Prize (See Rules 3 thru 6 for more details).
    2. By registering and placing a vote for “Canada’s Greatest Griller” (a “Voting Entry”) for a chance to win a Voter Prize (See Rules 7 thru 9 for more details).

    The Contest commences at 12:01:01 AM (ET) on May 1, 2007 and ends at 11:59:59 PM (ET) on September 30, 2007 (the “Promotional Period”).

    Entries for the Sweepstakes portion of the Contest can be received between 12:01:01 AM (ET) on May 1, 2007 and 11:59:59 PM (ET) on September 14, 2007 (the “Sweepstakes Closing Date”).

    The ability to vote for “Canada’s Greatest Griller” will commence at 12:01:01 AM (ET) on May 1, 2007 and end at 11:59:59 PM (ET) on September 30, 2007 (the “Voting Closing Date”).

  2. ELIGIBILITY: To enter the Contest and be eligible to win a Prize, a person must be a resident of Canada who has reached the age of majority in the province or territory in which he/she was residing at the time of entry into the Contest. Employees, officers, and directors (including immediate family members and members of the same household of such persons, including common law partners) of H.J. Heinz Company of Canada Ltd. (the “Sponsor”), their affiliates (including without limitation parent, sister and subsidiary companies), participating stores, agents, advertising or promotional agencies, suppliers of Prizes, and PROMORR (“the independent contest organization”) are not eligible to enter the Contest.

  3. HOW TO ENTER THE SWEEPSTAKES: No Purchase Necessary. Each Sweepstakes Entry must include: (a) your original favorite “Grilling” recipe that (i) is an original creation, (ii) includes a Diana Sauce or Marinade product, and (iii) has not been previously published or won another award AND (b) a video clip clearly capturing why you “the Sweepstakes entrant”, should be “Canada’s Greatest Griller” (Videos will be accepted in any one of the following formats: WMV, AVI, MOV or MPG). Maximum file size of 50mb. Hand held instruments, small props, costumes and accessories held or worn by the Sweepstakes entrant may be used and videos may be enhanced with graphics or special effects) OR a digital photograph of your recipe creation in JPG or GIF format at 72dpi and a maximum size of 100K.

    Commencing at 12:01:01 am (ET) on May 1, 2007, visit www.CanadasGreatestGriller.com and click on “Upload your own recipe” to enter the Sweepstakes. Complete the Registration Form by following these steps: (i) Fill out the on-line Entry Form with your salutation, full name, complete mailing address with postal code, daytime telephone number, e-mail address, and confirm that you have reached the age of majority in the jurisdiction in which you are residing; (ii) correctly answer the mathematical skill-testing question as set out on the on-line Entry Form without any mechanical assistance of any kind, (iii) review the Official Rules, (iv) include your original favorite “Grilling” recipe as explained above, (v) upload your own video clip by following the directions posted on the Contest webpage OR upload a picture of your creation by following the directions posted on the Contest webpage; and (vi) select the “submit” icon. Only one (1) e-mail address may be used by any person participating in the Contest. Limit one (1) on-line Sweepstakes entry per week per person. A week is defined as commencing at 12:01 am (ET) on a Monday and ending at 11:59 PM (ET) on a Sunday. All entries must be received by 11:59:59 PM (ET) on the Sweepstakes Closing Date.

    All entries become the property of the Sponsor upon receipt and none will be returned and each Sweepstakes entrant must assign and/or waive all rights to his/her recipe, video and or photograph including any and all copyright and/or moral rights, to the Sponsor including the right to publish the recipe, video and or photograph in future website, magazines, and/or the right to publish the recipe, video and or photograph in any future promotional materials, and/or the right to modify the recipe and or video all as determined by the Sponsor.

    The Sweepstakes entrant also confirms that the video or picture being submitted is an original video or picture and if it’s been produced with others or taken with others that you have permission to enter this video or picture into the Contest including assigning and/or waiving all rights to the video or picture submitted including any and all copyright and/or moral rights, to the Sponsor. In addition, the Sweepstakes entrant confirms that he/she has obtained the permission and consent of any other person featured in the video or picture to use the featured person’s image, voice, etc. (and if the person featured has not reached majority, the permission of their parent or guardian) for the purpose of entering the contest as well as the featured person’s (or in the case of a minor, the featured person’s parent or guardian’s) acknowledgement that their image, voice, etc. may be posted on a website and used in future advertisements of the Sponsor without any remuneration. The Sweepstakes entrant agrees to furnish the Sponsor with copies of the permissions from each featured person (or in the case of a minor, the featured person’s parent or guardian) upon request by the Sponsor.  The Sweepstake entrant should ensure that his/her video or picture submitted does not contain any commercial content that promotes any product or service other than the Sponsor’s products.

    All entries received between 12:01:01 AM (ET) on any given Monday and 11:59:59 PM (ET) on any given Sunday during the Sweepstakes will be reviewed for suitability for publication prior to be being posted for the public to vote. Sweepstakes Entries will be posted within five (5) business days or by the Friday following the Sunday closing time during the Sweepstakes. Once your Sweepstake Entry is posted, it becomes available for voting. Each Sweepstakes entrant will be given an opportunity to refer four (4) friends. If you refer four (4) friends you will receive four (4) additional entries for a chance to win a Voters Prize as defined in Rule 8 below.

  4. SUITABILITY FOR PUBLICATION: The Sponsor reserves the right to reject the entry of any Sweepstakes entrant if the production submitted with that entry, the video, the photo or the recipe as contemplated in these Official Rules, in the sole opinion of the Sponsor acting in its absolute discretion, would be inappropriate or would violate or offend any law, regulation, order, governmental policy, public policy or third party’s rights or could potentially expose the Sponsor to law suits, (such as containing any commercial content that promotes any product or service other than the Sponsor’s products), embarrassment, contempt, ridicule, or adverse publicity or otherwise reflect unfavorably on the Sponsor or any of its products.
  5. SWEEPSTAKES PRIZES: There will be a total of fifteen (15) Sweepstakes prizes available to be won (“Sweepstakes Prizes”).

    1. GRAND PRIZE: There will be one (1) grand prize (the “Sweepstakes Grand Prize”) available to be won that will be awarded to the Sweepstakes entrant with the highest overall score as determined by the Selection Committee (defined in Rule 6) (the “Sweepstakes Grand Prize Winner”).

      The Sweepstakes Grand Prize consists of $5,000 CDN spending money, a Broil-Mate BBQ model #115784-LP, a Genius BBQ cover, a Diana Grilling Kit (which consists of one (1) Diana Sauce and one (1) Diana Marinade in a Ziploc® container), and a Canada’s Greatest Griller apron and spatula. Approximate retail value of the Sweepstakes Grand Prize is $6,000 CDN.
    2. SECONDARY PRIZES: There will be three (3) secondary prizes (each a “Sweepstakes Secondary Prize”) available to be won with one (1) Sweepstakes Secondary Prize awarded to each regional Sweepstakes entrant with the highest overall score as determined by the Selection Committee (defined in Rule 6) except for the region where the Sweepstakes Grand Prize Winner is from. Regions are as follows: Region #1: Combining British Columbia and Territories (Yukon, North West Territories and Nunavut) and Alberta and Prairies (Manitoba and Saskatchewan); Region #2: The Province of Ontario; Region #3: The Atlantic Provinces (Newfoundland, P.E.I., New Brunswick and Nova Scotia) and Region #4: The Province of Quebec.
      Each Sweepstakes Secondary Prize consists of one (1) Broil-Mate BBQ model #115784-LP, a Genius BBQ cover, a Diana Grilling Kit (which consists of one (1) Diana Sauce and one (1) Diana Marinade in a Ziploc® container), and a Canada’s Greatest Griller apron and spatula. Approximate retail value of each Sweepstakes Secondary Prize is $1,000 CDN.
    3. MOST CREATIVE VIDEO PRIZE: There will be one (1) prize for the most creative video (the “Most Creative Video Sweepstakes Prize”) as determined by the Selection Committee (defined in Rule 6) available to be won, consisting of a Broil-Mate BBQ model #115784-LP, a Genius BBQ cover, a Diana Grilling Kit (which consists of one (1) Diana Sauce and one (1) Diana Marinade in a Ziploc® container), and a Canada’s Greatest Griller apron and spatula. Approximate retail value of the Most Creative Video Sweepstakes Prize is $1,000 CDN.
    4. HONOURABLE MENTIONS: There will be ten (10) honourable mention prizes (the “Honourable Mention Sweepstakes Prizes”) available to be won. Each Honourable Mention Sweepstakes Prize consists of a Diana Grilling Kit (which consists of one (1) Diana Sauce and one (1) Diana Marinade in a Ziploc® container). Approximate retail value of each Honourable Mention Sweepstakes Prize is $15.00 CDN.

      Prizes must be accepted as awarded without substitution and are not transferable, not for resale and have no cash surrender. The Sponsor reserves the right, in the event that a Prize or a component of a Prize cannot be awarded as described for any reason, to substitute a similar Prize or component of equal or greater value without liability. Limit one (1) Sweepstakes Prize per person or household. All Sweepstakes Prize winners are eligible to win a Voters Prize.
  6. SWEEPSTAKES SELECTION PROCESS: The fifteen (15) Sweepstake Entries with the highest number of votes from each voting category; Voting Category #1: British Columbia & Territories (Yukon, North West Territories and Nunuavut); Voting Category #2: Alberta & Prairies (Manitoba and Saskatchewan); Voting Category #3:  Ontario; Voting Category #4: Quebec and Voting Category #5: Atlantic Canada (Newfoundland, P.E.I., New Brunswick and Nova Scotia), as determined by the voters by the Voting Closing Date will be selected for a chance to win a Sweepstakes Prize. In addition, a random draw by the independent contest organization will be held on October 11, 2007 at 10:00 am (ET) to select an additional ten (10) entries from each of the defined Voting Categories above, among all eligible entries received on or before the Sweepstakes Closing Date (the “Sweepstakes Draw Date”). Odds of being selected depend on the total number of eligible entries received on or before the Sweepstakes Closing Date. The one hundred and twenty-five (125) entries’ answer to the mathematical skill-testing question set out on the on-line Entry Form must first be verified. In the event that a selected Sweepstakes entrant has incorrectly answered the mathematical skill-testing question, he/she will be disqualified and another Sweepstakes entrant will be selected until such time as one hundred and twenty-five (125) eligible entries have been confirmed.

    The one hundred and twenty-five (125) entries will then be reviewed by the Sponsor's selection committee (the “Selection Committee”) commencing on October 13, 2007 and will continue until fourteen (14) entries are selected on the basis of: (i) recipe inclusion of a Diana Sauce or Diana Marinade product; (ii) overall performance of the video or overall appearance of the photo submitted; (iii) style and creativity of the video/photo and recipe; and (iv) suitability of the recipe. In the event that there are more than fourteen (14) entries that qualify, all of these 14+ entries will be reviewed by the Selection Committee a second time based on originality and recipe appeal. Judging of the 14+ selected entries will be concluded on or before November 30, 2007. The entry that received the highest overall score will be declared the Sweepstakes Grand Prize Winner. The next three (3) entries (one (1) per region as defined in Rule 5, except the region where the Sweepstakes Grand Prize is from) with the highest overall score will each be declared a winner of the Sweepstakes Secondary Prize (each a “Sweepstakes Secondary Prize Winner”). The next ten (10) entries with the highest overall score will each be declared a winner of an Honourable Mention Prize (each an “Honourable Mention Sweepstakes Prize Winner”). From the remaining one hundred and eleven entries (111), all entries which included a video will be reviewed a second time by the Selection Committee commencing on November 30, 2007 and one (1) entry will be selected as the “Most creative video”. The entry that received the highest overall number of votes will be declared the winner of the Most Creative Video Sweepstakes Prize (the “Most Creative Video Sweepstakes Prize Winner”). The Selection Committee will consist of: four (4) employees from the Sponsor and three (3) employees from the Sponsor’s promotion agency, Accumark Communications, Inc.   

    Each of the potential Sweepstake Grand Prize Winner, the potential three (3) Sweepstakes Secondary Prize Winners, and the potential Most Creative Video Sweepstakes Prize Winner will be contacted by mail/courier or telephone within ten (10) business days of November 30, 2007 to sign a Release Form (as defined in Rule 10). In the event that the potential Winner cannot be contacted within ten (10) business days by mail/courier or telephone, the potential Winner may be disqualified, and at the sole and absolute discretion of the independent contest organization, his/her entitlement to receive a Prize will be forfeited, and the next Sweepstakes entrant with the highest overall score will be selected from the remaining eligible entries. The above process will be repeated until such time as there are fifteen (15) Sweepstakes Prize Winners and/or no more entries are available.  The ten (10) Honourable Mention Sweepstakes Prize Winners will be sent their Prizes by mail or courier to the address indicated on the Entry Form within thirty (30) days of November 30, 2007. If any Honourable Mention Sweepstakes Prize is returned as undeliverable, the entrant will be disqualified and the Honourable Mention Sweepstakes Prize will not be re-awarded.

  7. HOW TO WIN A VOTER PRIZE: No Purchase Necessary. Commencing at 12:01:01 am (ET) on May 1, 2007, visit www.CanadasGreatestGriller.com and select "vote for your favourite recipe” to enter the Contest. Click on the “vote” link underneath the griller you’d like to vote for and complete the following steps: (i) Fill out the on-line Entry Form with your salutation, full name, complete mailing address with postal code, daytime telephone number, e-mail address, and confirm that you have reached the age of majority in the jurisdiction in which you are residing; (ii) correctly answer the mathematical skill-testing question as set out on the on-line Entry Form without any mechanical assistance of any kind; (iii) review the Official Rules; (iv) place your vote for “Canada’s Greatest Griller”; and (v) select the “submit” icon (“Voter Entrant(s)”). Only one (1) e-mail address may be used by any person participating in the Contest. Limit one (1) on-line voting entry per day, per person.  All voting entries must be received by 11:59:59 PM (ET) on September 30, 2007 (the “Voting Closing Date”). 
  8. VOTER PRIZES: There will be a total of twenty-nine (29) prizes available to be won by voting (each a “Voter Prize”).

    9. VOTER GRAND PRIZES: There will be four (4) grand prizes available to be won (each a “Voter Grand Prize”). Each Voter Grand Prize consists of a Diana Grilling Kit (which consists of one (1) Diana Sauce and one (1) Diana Marinade in a Ziploc® container) and a Canada’s Greatest Griller apron and spatula. Approximate retail value of each Voter Grand Prize is $50.00 CDN.
    VOTER SECONDARY PRIZES: There will be twenty-five (25) secondary prizes available to be won (each a “Voter Secondary Prize”). Each Voter Secondary Prize consists of a Diana Grilling Kit (which consists of one (1) Diana Sauce and one (1) Diana Marinade in a Ziploc® container). Approximate retail value of a Voter Secondary Prize is $15.00 CDN.
    Prizes must be accepted as awarded without substitution and are not transferable, not for resale and have no cash surrender. The Sponsor reserves the right, in the event that a Prize or a component of a Prize cannot be awarded as described for any reason, to substitute a similar prize or component of equal or greater value without liability. Limit one (1) Voters Prize per household. All Sweepstakes Prize winners are eligible to win one (1) Voters Prize per household.

  9. VOTERS RANDOM DRAWS: The draws will be held on October 11, 2007 at 2:00 PM (ET) (the “Voter Draw Date”) by the independent contest organization in Oakville, ON from all eligible voter entries and from those Sweepstakes Entrants who received bonus voter entries on or before the Voting Closing Date and Sweepstakes Closing Date. First, four (4) Voter Grand Prize winners will be selected by random draws then twenty-five (25) Voter Secondary Prizes will be selected.  Odds of being selected for a Prize will depend on the total number of eligible entries received on or before the Voting Closing Date and or Sweepstakes Closing Date. Each of the twenty-nine (29) selected Voter Entrants’ answers to the mathematical skill-testing question must be verified before a selected Voter Entrant is declared the Winner of a Voter Prize. In the event that a selected Voter Entrant has incorrectly answered the mathematical skill-testing question, he/she will be disqualified and another Voter Entrant will be randomly selected until such time as twenty-nine (29) potential Voter Prize Winners have been confirmed and/or no more entries are available. The twenty-nine (29) Voter Prize Winners will be sent their Prizes by mail or courier within thirty (30) days of the Voter Draw Date. 
  10. RELEASE FORM: All selected entrants, except the Honourable Mention Sweepstakes Winners and the Voter Prize Winner’s, must complete and return a Declaration and Publicity Release Form (the “Release Form”). By completing and returning the Release Form and accepting a Prize, or in the case of Honourable Mention Sweepstakes Winners and Voter Prize Winners, by accepting a Prize, the Winner confirms compliance with the Official Rules; agrees to accept the Prize as awarded, without substitution; acknowledges that the Prize is not transferable or convertible to cash; releases the Sponsor and its respective affiliates and related companies, advertising and promotional agencies, the independent contest organization, and their respective shareholders, directors, officers, employees, participating stores and agents from and against all liability in connection with the Contest and the awarding and use of a Prize; and consents to the use of his/her name, address (city and province), and/or photographs/videos, without further remuneration, in connection with any publicity carried out by or on behalf of the Sponsor with respect to the Contest unless prohibited by law. Each Winner must assign and/or waive all rights to his/her recipe, video and or photograph including any and all copyright and/or moral rights, to Sponsor, including the right to publish the recipe, video and or photograph in future website, magazines, and/or the right to publish the recipe, video and or photograph in any future promotional materials, and/or the right to modify the recipe and or video all as determined by the Sponsor. The Release Form must be returned within the time period specified on the Release Form or the Winner’s Prize will be forfeited and another entrant will be randomly selected. The Winner’s Prize will be mailed or delivered by truck to each Winner's address as indicated on the Release Form within thirty (30) days of receipt by the Sponsor of the Release Form.  
  11. GENERAL: By entering the Contest, entrants (i) acknowledge compliance with these Official Rules including all eligibility requirements, (ii) agree to be bound by the Official Rules and by the decisions of the independent contest organization, made in its sole discretion, which shall be final and binding in all matters relating to this Contest, and (iii) assign and/or waive all rights to their videos and/or photo including any and all copyright and/or moral rights, to the Sponsor, including the right to modify the video and/or photo. Entrants who have not complied with these Official Rules are subject to disqualification.
  12. Limit of one (1) on-line Sweepstakes entry per person per week. Limit of one (1) on-line voting entry per person per day. Any person who is found to have entered more than the allotted number of entries will be disqualified and all entries received by such person during the Promotional Period will be disqualified. Proof of transmission (screenshots or captures etc) does not constitute proof of delivery. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. The Sponsor will not be responsible for late, lost, illegible, falsified, damaged, misdirected, mutilated, garbled or incomplete entries, which will be void.  All entries become the property of the Sponsor and none will be returned.
  13. The Sponsor and the independent contest organization do not assume any responsibility and are not responsible for (i) the incorrect or inaccurate capture of entry information and entries that fail to comply with the Official Rules; or (ii) any loss, damage, or claims caused by or resulting from the Contest or any Prize. 
  14. The Sponsor does not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer lines or networks, computer equipment, software or any combination thereof. Entry materials/data that have been tampered with or altered are void. Proof of transmission (screenshots or captures, etc.) does not constitute proof of delivery. Registrations generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified.
  15. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with (i) the laws of the Province of Québec and the laws of Canada applicable therein in respect of residents of the Province of Québec, and (ii) the laws of the Province of Ontario and the laws of Canada applicable therein in respect of residents of the other Canadian provinces/territories, without regard to conflicts of law principles. Any attempt by an entrant or any other individual to undermine the legitimate operation of the Contest could be a violation of criminal and civil laws and should an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. 
  16. The Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux, to terminate, suspend, or amend this Contest or to amend the Official Rules at any time and in any way, without prior notice, for any reason whatsoever. Without limiting the foregoing, if for any reason the on-line portion of the Contest is not capable of running as originally planned because of, for example, tampering or infection by computer virus, the Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux, to cancel the on-line entry Sweepstakes portion and the Voting portion of the Contest and to conduct a random draw to select fifteen (15) Sweepstakes Winners and twenty-nine (29) Voter Winners from the eligible entries received. The Sponsor shall not be held responsible for any problems, errors, or negligence that may arise or occur in connection with the Contest including but not limited, to any damage to an entrant's computer equipment, system, software or any combination thereof, as a result of the entrant's participation in the Contest.
  17. If a dispute arises regarding who submitted an on-line entry, the entry will be deemed to have been submitted by the authorized account holder of the e-mail address provided at the time of entry. The authorized account holder is defined as the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
  18. All entries become the permanent property of the Sponsor and none will be returned. No correspondence will be entered into except with the selected entrants. This Contest is void where prohibited by law and is subject to all applicable Federal, provincial and municipal laws.
  19. Any litigation respecting the conduct or organization of this Contest in Québec may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a Prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement. 
  20. CONSENT TO USE PERSONAL INFORMATION: When you voluntarily choose to register electronically to participate in the Contest, personal information including, but not limited to, your e-mail address, first name, last name, city, province, postal code, and home phone number (collectively "Registrant Information") will be collected from you by the Sponsor. By entering this Contest electronically and providing your Registrant Information, you consent and agree to: the Sponsor’s collection and use of the Registrant Information to administer this Contest only, unless you have consented to become a member of the Diana Gourmet Circle Sponsored by Diana Sauce and Marinade.  To view the Sponsor’s privacy policy click here.
